Ramabhaktarealestates.com ("Site") is an electronic web-based platform for exchanging, exploring, and enhancing real estate, housing, and property business online in India. The Company is owned and managed by Sri Ramabhakta Real Estate LLP.
By using this website, you acknowledge and accept the following Terms and Conditions ("Terms"). Before using any of the Site's services ("Services"), all Users must read carefully, fully understand and agree with the terms mentioned below. Those legally able to form legally binding contracts under Indian law are eligible to use the Services. This Site may be amended at any time by Sri Ramabhakta Real Estate LLP. Upon posting on this Site, the amended version shall automatically take effect.
This Agreement applies to all persons who access the Site for whatever purpose, regardless of whether they have registered with RB spaces as registered Users or are paying Users for specific services provided by RB spaces. The term "User" includes anyone who uses this Site and any legal entity that that person might represent.
A person who accesses the services without the legal or contractual right to do so will fall under the definition of an 'unauthorized user' and is subject to the terms and conditions, specifically about respecting the provider's intellectual property rights and adhering to licensing terms.
The person/entity who joins the portal RB spaces with only the intention of listing and showcasing his business online without utilizing any specialized services.
The Site and certain features are free for all Users. The Site may, without prior notice, restrict access to certain areas or features of the Site ("Paid Services") to paying Users or those who have completed a specific registration process. A separate agreement governs access to and use of these Paid Services in addition to this Agreement.
As amended, you're looking at the Real Estate (Regulation and Development) Act, 2016. By using the Site and its Services, the Users represent and warrant that (a) All registration information submitted is truthful and accurate; (b) Users must keep their information accurate; (c) Users have to be 18 or older, and (d) No laws or regulations are violated when using the Site. (e) If a user violates these terms, his profile may be deleted and his membership may be terminated without warning. (f) The Site will hold no liability for any direct or indirect damages or any damages arising from use, loss of use, data, or profits, whether arising in a contract, negligence, or tort.
If any user/individual; /entity becomes aware of any inappropriate content by any User of this Site, we will remove the offending material. This includes, without limitation, unlawful conduct that may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content.
As an intermediary, our role is limited. If you have any concerns about copyright infringement, we shall appreciate it if the same is brought to our notice. It is beyond our scope to verify that the User of the Site has posted only products and services on which they have complete authorization/ownership/dealership / selling rights. The Site has no expertise in the domain of intellectual property rights.
The Site shall not be liable for any such information or data that is not within its knowledge/acknowledgement/contraventions/copyright issues committed by its Users and beyond the control of verification.
RB spaces may amend this Agreement at any time by posting an amended and restated Agreement on the Site. It shall become effective immediately upon posting. If you continue to use the Site after RB spaces posts the amended and restated Agreement, you are deemed to have accepted the amended terms. A modification to this Agreement must be in writing and signed by an authorized officer of RB spaces.
After receipt of activation charges, membership is activated within 2 working days and continues for the duration of the charges. However, the Web pages are created per the information/approval provided by the User and may take some time; however, no relaxation will be provided/allowed for the said period.
RB spaces or the parent company is not responsible for the costs/damages/extension of the activation period etc., for the same in any manner under any circumstances. The Users are advised to spool the messages offline and save them elsewhere to avoid hacking or technical problems.
During registration or subsequently, users agree to accept communications (calls, chats, emails, SMS) on the numbers provided during registration. Any form that has a phone number/mobile number, regardless of whether they're on the Do Not Call Registry or any other form that has that info; the company / your number / the assigned point of contact; for services subscribed to by RB spaces, Sri Ramabhakta Real Estate LLP.
RB spaces owns and retains other proprietary rights in the Site and the services. The Site contains copyrighted material, trademarks, and other proprietary information of RB spaces. You may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information except for that information which is in the public domain or for which you have been given permission.
Intellectual property rights and rights accruing from the same, statutory or otherwise, are reserved by the Company and its associates. This Site does not grant the User any license or right to use these Marks in any way.
Using the Services offered by the Site in a way that harms the Site's interests and functions and isn't compliant with laws and regulations is prohibited. The User will not allow anyone other than the authorized person(s) to use the Service. Service can only be used for the purpose for which it's subscribed. All applicable laws relating to the Services, including any regulations made under them, will be complied with by the User. Users shall not use the Service for any unlawful purpose, including but not limited to criminal activity. The User shall not use the Service to send or receive any offensive, vulgar, obscene, malicious, or menacing message.
Any User or third party who accesses RB spaces without reasonable cause or causes peril, harassment, annoyance, irritation, or anxiety to any other User or third party is prohibited from sending messages or postings.
It's illegal for the User to introduce, upload, post, distribute, publish or transmit any information or software that:
The Company can delete any material relating to the violations by the User. The Company will warn the User to cease any activity that leads to the said violations. If the User continues with such activity, the Company has the sole authority to terminate or suspend the membership at RB spaces and/or any other related facility.
Copyrighted material, trademarks, or other proprietary information may not be posted, distributed, or reproduced without the written consent of the owner. Your work may have been copied and posted on the RB spaces Service in a manner that constitutes copyright infringement. Please provide our Copyright Agent with the following information: the electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest. RB spaces's Copyright for Notice of claims of copyright infringement can be reached by writing to the address in the Contact Us section on the Site.
Since RB spaces is an online platform, it is not responsible for any breach of privacy caused by a technical problem or otherwise, as the information provided by Users on the Site is not protected by RB spaces.
RB spaces is liable to share all information available with it in response to any legal proceedings, including and not restricted to court orders, notices, subpoenas, FIR etc. Users need to be aware that when they voluntarily reveal identification-oriented information Sri Ramabhakta Real Estate LLP, [email protected] to anyone resulting in unsolicited messages from third parties, such interaction is beyond their control and liability.
The intellectual property of RB spaces shall be automatically assigned to the Company and the User shall have no right or claim over the same. If the User uses the such intellectual property in any other website or related activity, the same can be construed as an infringement of the Company's intellectual property.
By using this Site, the Users understand that all the information provided by you is public and can be accessed by other Users of the Site. The User's data may be used by all divisions/sister concerns/ventures of the RB spaces to carry out the project's purpose.
RB spaces is committed to respecting the online privacy of its Users and doesn't intend to sell, rent or share Users' Personal Information with Third Parties. Use of the Site's Services constitutes your consent to the collection, storage, and use of any personal information you provide (including any changes thereto as provided by you).
To improve the User's experience on the Site, "cookies" and other tracking technologies are used, as well as traffic analysis to reveal trends and statistics.
The User's sole responsibility is to verify and validate the information on the Site. You have sole authority to access and update all the information posted by you on the Site and it is your responsibility to keep the same updated. Access to site services, including updation / deletion of the profile, may be restricted/denied if it comes to the notice of RB spaces that this would violate anybody else's rights.
RB spaces only provides a platform to showcase the property/project listings and has no role in any transaction or communications. Hence, it shall not be liable for any loss or damage arising out of the use and/or temporary or permanent discontinuation of its services. The amount you have paid, if any, for your Site membership will always be your maximum liability.
RB spaces cannot monitor the responses received by any User in response to the information posted by them. Users should conduct background checks on the bonafide nature of all response(s). This website is a public site with free access and assumes no liability for the quality and genuineness of responses.
Warning: The User is warned against disclosure of any personal/confidential/sensitive information to any previous or current employee of the Company. The Users would initiate no requests to incorporate any such feature in the mobile app version. Site / Company shall not be liable for the outcome of any such transaction of information, including and not limited to damages for loss of profits or savings, business interruption or information loss.
RB spaces is not responsible for any loss or damage arising from the use and/or temporary or permanent suspension of its services. The mobile application version may not include certain free and paid features on the original website. These are requests posted by buyers whose receipt depends on popularity, trends, etc., which RB spaces isn't in charge of. The Users would initiate no requests to incorporate any such feature. Each User hereby represents, warrants and agrees that the same shall be acceptable as a matter of fact and the Users would initiate no requests to incorporate any such feature in the mobile app version. RB spaces may offer Complimentary leads to the Users with certainly paid packages / some special schemes. Still, the Users shall not hold RB spaces liable for the same as this is subject to availability.
Requesting a refund of Property leads within 5 days of purchase is necessary if the contact details are not contactable. As we are not involved in monitoring our users' deal finalization, transactions, or preferences, refund requests resulting from cancelled or fulfilled leads will not be entertained.
Refund requests cannot exceed 25% of the assigned Property leads quota and can be processed directly via the member folder once the limit has been reached, regardless of the reason for the refund.
By using this Service, the User agrees and irrevocably authorizes the Company to:
The Company makes no representations and warranties of any kind, whether expressed or implied, for the Services and in relation to the accuracy or quality of any information transmitted or obtained at RB spaces. The Site will not be liable for any indirect or consequential damages arising from inaccurate/discrepant information posted on the Site.
Aside from its subsidiaries, affiliates, officers, agents, and other partners and employees, you agree to indemnify and hold RB spaces and its subsidiaries, affiliates, officers, agents, and other partners and employees harmless from any loss, liability, claim, or demand made by a third party, including reasonable attorney's fees, if you use the Service in violation of this Agreement, break these Terms of Use, or fail to fulfil your representations and warranties.
At any time, the Company may amend the terms and conditions contained herein and in the Services Guide upon notice to the User. RB spaces will update the Terms and Conditions from time to time. The User should check the Site periodically for updates. Using the Service, the User affirms and acknowledges the amended terms and conditions.
The payments for services at RB spaces must be made to RB spaces. All payments must be made in advance to continue using uninterrupted Paid Services.
You are informed that under no circumstances will RB spaces be liable for any damage caused due to your transactions/payments made to / in favour of such fraudulent individuals/organizations. The User, liable to pay Subscription Fees, shall pay it on demand even if the User disputes the same for any reason.
User payments for Paid services won't be refunded. RB spaces neither guarantees accuracy, timeliness, or authenticity nor endorses any content posted by other users. The services are all best effort.
All activities and transmissions performed through the User's My Folder are solely his responsibility. Any online or offline transaction involving credit cards/debit cards or other instruments or documents is solely their responsibility. RB spaces accepts no liability for the improper use of credit or debit cards used by subscribers.
Because we at RB spaces maintain high levels of interaction with our clients and complete the entire process with their approval, there is no provision for full or partial refunds. An order is immediately sent for processing as soon as it is placed. You cannot claim a refund or chargeback because your preferences have changed.
RB spaces reserves the right to partially suspend the User's access to certain features, panels, and access points or fully terminate a User's Account at any time without assigning any reason or notice to the User (Free and Paid Members) to protect the interests of other Users of RB spaces.
The User (s) would lose access to the Site's Free and Paid Services and would not be able to re-register with new information unless RB spaces agrees in writing. In case of termination, no membership/subscription fee will be refunded to the User (s). RB spaces isn't liable for any direct or indirect damage caused by such termination.
RB spaces reserves the right, but is not required, to monitor disputes between Members at RB spaces. For any transactions on the Site, RB spaces is not a party to any legal proceedings. RB spaces will always comply with governing / legal authorities' orders and cooperate fully through the process but in such cases.
The User and the Company submit to the exclusive jurisdiction of the courts in India for any dispute or matter arising from incidental use of RB spaces. You agree that this Agreement constitutes the entire agreement between you and RB spaces regarding your use of the Site and/or Service. The remainder of this Agreement shall remain in full force and effect if any provision is held invalid.
